<p>Estate planning is a crucial part of ensuring your legacy is preserved and passed on in the most efficient and compassionate manner. One of the most powerful tools available in South Africa’s estate duty framework is the Section 4(q) deduction, which offers significant relief, particularly for a surviving spouse.</p>
<p>This provision allows any inheritance left to a surviving spouse to be excluded from the dutiable estate when calculating estate duty. It’s a mechanism designed to protect the financial security of a spouse following the loss of a partner who may have been the primary provider.</p>
<h3>What Does Section 4(q) Say?</h3>
<p>According to the Estate Duty Act 45 of 1955, Section 4(q) provides that the value of any property left to a surviving spouse is deductible from the deceased’s estate, with a few exceptions:</p>
<p>1. If the will requires the surviving spouse to transfer part of the inheritance to someone else, that portion cannot be deducted.<br />
2. If the inheritance is directed to a discretionary trust (even if the spouse is a beneficiary), the deduction is not permitted unless the spouse is the sole and exclusive beneficiary of the property or income.</p>
<p>Notably, the Act doesn’t define the term “spouse” itself. Instead, we look to the Income Tax Act 58 of 1962, which defines a spouse as someone who is:</p>
<p>• Legally married (civil or customary marriage).<br />
• In a religiously recognised union.<br />
• In a same-sex or heterosexual union intended to be permanent.</p>
<p>In these cases, “married”, “husband” or “wife” are interpreted to include all such partnerships, provided the relationship is established as permanent. A cohabitation or life partnership may qualify, depending on how well the permanence of the relationship is documented.</p>
<h3>Where the Definition Falls Short</h3>
<p>While the current definition of a spouse is relatively broad, it still excludes many types of households where financial dependence exists. For example:</p>
<p>• Single-parent families (never married or divorced)<br />
• Households supported by grandparents or extended family<br />
• Families relying on children or siblings for support</p>
<p>In these cases, no Section 4(q) relief is available, meaning the estate may be subject to higher estate duty, potentially burdening those who were dependent on the deceased.</p>
<p>To address this, some policy advisers have recommended scrapping the Section 4(q) deduction in favour of increasing the primary abatement, which currently sits at R3,500,000 – a threshold that hasn’t been adjusted since 2010.</p>
<h3>How to Maximise Section 4(q) Relief Under Current Rules</h3>
<p>Until policy reforms are implemented, there are still several strategic ways to leverage Section 4(q) to benefit your loved ones.</p>
<h4>1. Bequeath the Entire Estate to Your Spouse</h4>
<p>This is the most straightforward way to eliminate estate duty: by leaving everything to your spouse, the entire value is deductible from your dutiable estate. It ensures your spouse receives their inheritance free of this tax burden.</p>
<h4>2. Use Vested Trusts for Blended Families</h4>
<p>In blended families, where the surviving spouse may not be the parent of all the children, a vested trust can balance interests. The spouse receives income from the trust during their lifetime, while children are named as capital beneficiaries. This structure satisfies Section 4(q) and also ensures children receive their rightful inheritance down the line.</p>
<p>This method can be especially valuable when children live abroad, as the inheritance may be treated more favourably for tax purposes in their home country.</p>
<h4>3. Consider Usufruct Arrangements</h4>
<p>If setting up a trust isn’t ideal, a usufruct offers another solution. This allows the spouse to use or benefit from an asset (such as a home) during their lifetime, while ownership passes to children. The value of the usufruct – calculated using a standard formula based on asset value and life expectancy – is deductible under Section 4(q), reducing estate duty.</p>
<h4>4. Formalise Life Partnerships</h4>
<p>For couples who live together but are not legally married, it’s essential to demonstrate the permanence of the relationship. A cohabitation agreement or life partnership contract can serve as strong evidence of intent and dependency. Such agreements don’t require the sharing of assets, but they do confirm long-term commitment, which may satisfy the legal definition of a spouse for estate duty purposes.</p>
<h3>In Summary</h3>
<p>Section 4(q) remains a valuable estate planning tool in South Africa — but only if the estate is structured correctly and the surviving partner qualifies under its definitions. With the current primary abatement unchanged for over a decade, careful planning is essential to minimise estate duty and protect your family’s financial future.</p>

<p><span data-fusion-font="true" style="font-size: 20px;">In this month’s issue, we will look at POPIA (The Protection of Personal Information Act)</span><br /><span data-fusion-font="true" style="font-size: 20px;"><br />
POPIA is certainly not your average “poppie”.</span></p>
<p data-fusion-font="true" style="font-size: 20px;">The current Covid-19 pandemic and the resultant lockdown restrictions have had a global impact on all governments, industries and economies. It has also inevitably slowed down the judiciary’s wheels of motion by which new legislation is put in place. However, of late, those wheels have been slowly put back in motion and one of the newest pieces of legislation is POPIA.</p>
<p data-fusion-font="true" style="font-size: 20px;">On 22 June 2020, the President issued a Proclamation regarding the commencement of certain sections of the POPI Act. The Act took effect 01 July 2020. The act aims to protect personal information, falling into the broader Constitutional right to privacy. POPIA seeks to regulate every step of the processing of personal information from how personal information must be handled when it is collected until the time it is destroyed. All entities/institutions have however been given a grace period of 12 months to ensure that they fully comply to the regulations.</p>
<p data-fusion-font="true" style="font-size: 20px;">As referred to earlier, the entire global economic landscape has been impacted and probably forever changed. Things will never be as before. This is also evidently noticeable in the way financial transactions are concluded. The old normal face-to-face consultations, meetings and signing of hard-copy documents are visions of the past.</p>
<p data-fusion-font="true" style="font-size: 20px;">This “new normal” way of financially transacting now places even greater importance of the protection of personal information, and hence also the greater impact of legislation such as POPIA.</p>
<p data-fusion-font="true" style="font-size: 20px;">As an administrator of member info, mCubed Employee Benefits and its service provider network have put increased measures in place to ensure the safety of member and employer information at all times.</p>
<p data-fusion-font="true" style="font-size: 20px;">It however remains the ultimate responsibility of each individual to keep his/her personal information as confidential as possible. As an administrator, we would therefore encourage each member and employee to ensure that their personal information is correctly captured at employer HR level, as this would be the information that gets uploaded to the retirement Fund’s database.</p>
<p data-fusion-font="true" style="font-size: 20px;">To end off, just a reminder of a few simple notes that we can all implement to ensure the safety of our personal information</p>

Covid-19 changed the way we service our clients – our usual face-to-face member information sessions have been replaced with virtual interactions.</p>
<p>This “new norm” has encouraged members to utilize our secure and user-friendly App to view their investment performance and engage with mCubed on a daily basis. We post short, simple and easy reading material on a weekly basis on the app under “news feed” providing members with immediate information about the local and global events that have directly impacted their investments to date. Members also now have direct access to their Client Relationship Manger (CRM) – no call centres or answering machines making members spend their airtime waiting for an answer. The relevant CRM makes contact with our members within minutes of the initial request – the information our members require is now at their fingertips – literally at the click of a button the relevant explanation is provided to our members.</p>
<p>During these uncertain times we want to make all our members feel that they have someone to speak to, someone who will listen to them.  It is not only designed to impower members of all ages but is a direct and confidential channel to get the answers to the questions specific to our members current needs. Anything from retrenchment questions, tax implications relating to retrenchments, loan options, investment queries or simply just wanting to know how members can retire comfortably, our App is there to provide our members with a sense of security knowing that mCubed is there to help them through this trying time.</p>
